A partir de 2026, esa obligaci\u00f3n general se convertir\u00e1 en una regla concreta, con <strong>cifras claras de velocidad y distancia<\/strong>. La nueva normativa introduce un marco m\u00e1s estricto que modifica de forma relevante lo que hasta ahora establec\u00eda la legislaci\u00f3n espa\u00f1ola.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfQu\u00e9 exige la normativa actual?<\/h2>\n\n\n\n<p>En la actual normativa, el Reglamento General de Circulaci\u00f3n no establece una pauta espec\u00edfica para adelantar a un veh\u00edculo detenido por aver\u00eda que ocupe parte de la calzada. La ley se limita a exigir al conductor que <strong>extreme la precauci\u00f3n<\/strong>, <strong>adapte la velocidad<\/strong> a las circunstancias del tr\u00e1fico y mantenga una separaci\u00f3n lateral suficiente para realizar la maniobra con seguridad.<\/p>\n\n\n\n<p>La referencia que queda m\u00e1s cerca es la obligaci\u00f3n de dejar una distancia lateral m\u00ednima de 1,5 metros, pero esta se aplica de forma expl\u00edcita a los <strong>adelantamientos a ciclistas<\/strong> y otros usuarios considerados vulnerables, no a veh\u00edculos inmovilizados. En la pr\u00e1ctica, adelantar un coche averiado se rige por criterios propios del conductor, como son comprobar que el carril contrario est\u00e1 libre, se\u00f1alizar la maniobra, reducir la velocidad y no poner en riesgo a otros usuarios.<\/p>\n\n\n\n<p>Esto deja un amplio margen de interpretaci\u00f3n tanto al conductor como al agente que pueda sancionar una maniobra considerada imprudente. No hay una cifra concreta de reducci\u00f3n de velocidad ni una distancia lateral fijada por norma, y eso es precisamente lo que la DGT soluciona con esta nueva normativa.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 cambia a partir de 2026?<\/h3>\n\n\n\n<p>En 2026, por primera vez, los requisitos ser\u00e1n claros y cuantificables para este tipo de situaciones. Ahora:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cuando un veh\u00edculo est\u00e9 detenido por aver\u00eda y ocupe parte del carril, el adelantamiento deber\u00e1 realizarse <strong>reduciendo la velocidad en al menos 20 km\/h<\/strong> respecto al l\u00edmite m\u00e1ximo de la v\u00eda y manteniendo una separaci\u00f3n lateral m\u00ednima de 1,5 metros.<\/li>\n<\/ul>\n\n\n\n<p>Esta norma copia la f\u00f3rmula que ya se aplica en los adelantamientos a ciclistas en carreteras convencionales y lo extiende a situaciones con presencia de veh\u00edculos inmovilizados en la calzada. El objetivo es, por un lado, <strong>reducir la velocidad a la que se podr\u00eda impactar<\/strong> y aumentar el margen de seguridad para los ocupantes del veh\u00edculo averiado, as\u00ed como para los operarios o peatones que puedan encontrarse en su entorno.<\/p>\n\n\n\n<p>Adem\u00e1s, al fijar cifras concretas, la norma <strong>elimina la ambig\u00fcedad<\/strong> existente hasta ahora y facilita tanto el cumplimiento por parte del conductor como la labor de control por parte de la autoridad.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Qu\u00e9 diferencias exactas hay<\/h3>\n\n\n\n<p>Hasta ahora, reducir la velocidad era una recomendaci\u00f3n que entraba dentro de la l\u00f3gica, pero a partir de 2026 ser\u00e1 una obligaci\u00f3n que se podr\u00e1 incluso sancionar si no se cumple. Lo mismo ocurre con la distancia lateral, que pasa de ser un concepto gen\u00e9rico a una cifra m\u00ednima exigible.<\/p>\n\n\n\n<p>Por otro lado, la nueva norma asume que un veh\u00edculo averiado supone un riesgo comparable al de un usuario vulnerable, especialmente en v\u00edas r\u00e1pidas, y por eso adopta criterios similares a los ya existentes para ciclistas.<\/p>\n\n\n\n<p>Cuando la norma entre en vigor, el conductor deber\u00e1 identificar claramente el l\u00edmite de velocidad de la v\u00eda para calcular la reducci\u00f3n obligatoria. En una carretera limitada a 90 km\/h, por ejemplo, el adelantamiento deber\u00e1 realizarse como m\u00e1ximo a 70 km\/h.
